30 years imprisonment without knowing what the crime is – Shock about Perarivalan!

There is an article in the Hindu English daily pointing out the injustice done to
\nPerarivalan from the very beginning. Written by Anup Surendranath and Trisha Chandran.
\n<\/span><\/strong><\/h4>\n

Its summary is as follows –<\/span><\/strong><\/h4>\n

In the assassination of Rajiv Gandhi, the biggest injustice was that government
\nagencies continued to imprison Perarivalan without knowing for sure what his role was.
\n<\/span><\/strong><\/h4>\n

Identifying those who were at the center of this murder plot and not
\nbeing able to arrest them and sacrificing the lives of the perpetrators
\non the margins in this case is truly a fantastic example of the course of state institutions.<\/p>\n

<\/span><\/strong><\/h4>\n

The trial court first upheld the charges against Perarivalan
\nunder the Central Intelligence Agency, TADA and the Indian Penal Code.
\nAfter various legal battles, only the charge against the
\nIndian Penal Code was accepted and he was jailed for 30 years.<\/span><\/strong><\/h4>\n

His death sentence was commuted to life imprisonment in February 2014.
\n<\/span><\/strong><\/h4>\n

According to the Indian Witness Law, a confession given to a
\npolice officer is not valid. But in the Tada and Potash Act,
\na confession made to a person not under the rank of District Superintendent was accepted.
\n<\/span><\/strong><\/h4>\n

The CBI’s main weapon was Perarivalan’s confession to
\nSuperintendent of Police V. Thiagarajan that he had bought
\ntwo nine-volt car batteries and given them to the main culprit,
\nand that the battery had been used in the bombing that killed Rajiv Gandhi.<\/p>\n

<\/span><\/strong><\/h4>\n

However, in November 2013, Thiagarajan of the Police Department
\nsubmitted to the Supreme Court in December 2017 a affidavit
\nstating that he had not accurately recorded the confession
\npreviously given by Perarivalan.
\n\"\"
\n<\/span><\/strong><\/h4>\n

In it, Thiagarajan had stated that he had left the record of
\nwhat Perarivalan had said at the outset that
\nhe did not know what the battery was bought for.<\/p>\n

<\/span><\/strong><\/h4>\n

In essence, Perarivalan was convicted of
\na false confession written by a police officer.<\/span><\/strong><\/h4>\n

Details of who \/ how the bomb used in Rajiv’s
\nassassination was made are unclear in the CBI investigation. <\/span><\/strong><\/h4>\n

The Judiciary found the MC Jain Report (Jain Committee Report)
\nsubmitted to Parliament in March 1998.
\n<\/span><\/strong><\/h4>\n

So to deal with such issues, the Multipurpose Monitoring
\nAgency (MDMA) was formed in December 1998 Developed by CBI.<\/span><\/strong><\/h4>\n

Its purpose was to investigate the details of the plot to
\nassassinate Rajiv and the source of the bomb used in the assassination.
\n<\/span><\/strong><\/h4>\n

For the past two decades the Multi-Purpose Surveillance
\nAgency has been submitting closed envelope reports to the Tada Court.
\nBut Perarivalan was denied permission to see these.
\n<\/span><\/strong><\/h4>\n

However, the Multipurpose Surveillance Agency has repeatedly
\nstated that the perpetrator and his accomplices were not
\npart of the ongoing investigation. That is, the source of the bomb,
\nand how it was made, remains unknown at the highest level of the state.<\/p>\n

<\/span><\/strong><\/h4>\n

However, without knowing for what purpose the battery was purchased,
\nPerarivalan continues to be imprisoned for the crime of purchasing the battery.
\n<\/span><\/strong><\/h4>\n

Despite such a grand conspiracy background, Perarivalan and his mother,
\nthe wonderful mother, continue their relentless
\nstruggle to end Perarivalan’s imprisonment.
\n<\/span><\/strong><\/h4>\n

However, under Section 161 of the Constitution,
\nPerarivalan is entitled to an apology from the Governor of Tamil Nadu.
\nHis application for apology has been pending with the governor since 2015.<\/p>\n

<\/span><\/strong><\/h4>\n

Meanwhile, the Union government is using the ambiguity as a
\ntactic to extend Perarivalan’s imprisonment.
\nThe Union government first achieved that the problem
\nof forgiveness was entirely between the
\ngovernor and the superintendent.<\/p>\n

<\/span><\/strong><\/h4>\n

But in December 2020, the Union government advanced an argument
\nin the Supreme Court that was unacceptable under the Constitution.
\nThat is, it said that the power to pardon
\nPerarivalan rested with the President of India.<\/span><\/strong><\/h4>\n

\u00a0<\/span><\/strong><\/h4>\n

The Union government re-submitted its report to the
\nSupreme Court on January 21 that the governor would
\nmake a decision on the apology within a few days.<\/span><\/strong><\/h4>\n

This is a shocking violation of constitutional duty.
\nAnd the governor, who is obliged to follow the advice
\nof the state government under the Constitution,
\nhas taken blatant, illegal action to ignore it.<\/p>\n

<\/span><\/strong><\/h4>\n

He was 19 years old at the time of his arrest.
\nThirty years later, he is still fighting for his release.<\/p>\n

<\/span><\/strong><\/h4>\n

In these 30 years, he has completed BCA and MCA degrees at
\nIndira Gandhi National Open University and various
\ndiploma courses in motorcycle mechanics,
\nmanagement skills and nutrition.<\/p>\n

In his book, A Request from the Gallows,
\nhe stated that the Multipurpose Surveillance
\nAgency would find that he had nothing to do with the bomb.
\nHe then asks us who can restore his lost life.<\/p>\n

We must ask ourselves why Perarivalan is still in prison,
\nknowing that Perarivalan’s confession has been forged,
\nthat the state agencies themselves admit that they
\nknow nothing about the source of the bomb, and that
\nPerarivalan has no role in the bomb investigation.<\/p>\n
